The Website is owned and operated by Executive Coaching International Inc. (“Executive Coaching International”). The Website is offered subject to your acceptance without modification of all of the terms and conditions contained herein and all other operating rules, policies (including, without limitation, Executive Coaching International’s Privacy Policy) and procedures that may be published from time to time on this Site by Executive Coaching International Inc. (collectively, the “Agreement”).

Please read this Agreement carefully before accessing or using the Website. By accessing or using any part of the website, you agree to become bound by the terms and conditions of this Agreement. If you do not agree to all the terms and conditions of this Agreement, then you may not access the Website or use any services. If these terms and conditions are considered an offer by Executive Coaching International Inc., acceptance is expressly limited to these terms. The Website is available only to individuals who are at least 13 years old.

1. Payment

General Terms. By selecting a product or service, you agree to pay Executive Coaching International Inc. the one-time and/or monthly, quarterly or annual subscription fees indicated (additional payment terms may be included in other communications). Subscription payments will be charged on a pre-pay basis on the day you sign up for an Upgrade and will cover the use of that service for a monthly, quarterly or annual subscription period as indicated. There are no refunds for money already collected. All sales are final. Any payments made 12 months prior (regardless of the purchase terms) are non-refundable.

Occasionally Executive Coaching International Inc. will offer discounts on the programs. If you make a purchase and Executive Coaching International offers a discount on the program after your purchase, you are not granted a refund of the difference.

Logging Into Your Account. If you cannot locate your log in information you can always click the “forgot password” link to reset your password. If you still cannot access your account, please send us an email directly. Not receiving a purchase confirmation email or log in instructions is not grounds for a refund.

Automatic Renewal. For monthly subscriptions only. Unless you notify Executive Coaching International Inc. before the end of the applicable subscription period that you want to cancel a subscription, your subscription will automatically renew and you authorize us to collect the then-applicable annual or monthly subscription fee for such subscription (as well as any taxes) using any credit card or other payment mechanism we have on record for you. Executive Coaching International Inc. is not obligated to refund any charges that occurred before your cancellation request.

Upgrades can be canceled at any time by submitting your request to Executive Coaching International Inc. in writing.

Money Back Guarantee. A money back guarantee is occasionally offered by Executive Coaching International. In order to qualify for the money back guarantee you must: (a) make the request within 2 weeks from your purchase, (b) attend at least 2 weekly group meetings each week during the money back guarantee period, (c) log into the account and complete the program assignments during the money back guarantee period, and (d) complete the orientation meeting and/or videos prior. If you have not completed these conditions, you will not be eligible for a money back guarantee.

2. Responsibility of Website Visitors

Executive Coaching International Inc. has not reviewed, and cannot review, all of the material, including computer software, posted to the Website, and cannot therefore be responsible for that material’s content, use or effects. By operating the Website, Executive Coaching International Inc. does not represent or imply that it endorses the material there posted, or that it believes such material to be accurate, useful or non-harmful.

You are responsible for taking precautions as necessary to protect yourself and your computer systems from viruses, worms, Trojan horses, and other harmful or destructive content. The Website may contain content that is offensive, indecent, or otherwise objectionable, as well as content containing technical inaccuracies, typographical mistakes, and other errors.

Executive Coaching International Inc. disclaims any responsibility for any harm resulting from the use by visitors of the Website, or from any downloading by those visitors of content there posted.

3. GDPR Compliance

You agree and accept that Executive Coaching International will be using your personal data entered here to deliver the product or service you are purchasing and to communicate relevant information about the delivery of the product or service to you. In accepting this Agreement you are indicating that you have read and accepted our Privacy Policy and our Terms of Use.

4. Content Posted on Other Websites

We have not reviewed, and cannot review, all of the material, including computer software, made available through the websites and webpages to which https://www.pameladunn.com links, and that link to https://www.pameladunn.com. Executive Coaching International Inc. does not have any control over those non-Executive Coaching International Inc. websites and webpages, and is not responsible for their contents or their use.

Executive Coaching International Inc. disclaims any responsibility for any harm resulting from your use of non-Executive Coaching International Inc. websites and webpages.

5. Copyright Infringement and DMCA Policy

9. Partner Products

By activating a partner product, you agree to that partner’s terms of service. You may opt out at any time by deactivating the partner product.

11. Termination

No specific results are guaranteed. Your success depends on many factors including your participation and implementation.

All methods, materials, and strategies are confidential and proprietary. Unauthorized disclosure may result in legal action.

16. Limitation of Liability

Executive Coaching International Inc. shall not be liable for damages exceeding the fees paid in the prior twelve (12) months.

17. General Representation and Warranty

You represent that your use of the Website complies with all applicable laws and does not infringe third-party rights.

18. Indemnification

You agree to indemnify and hold harmless Executive Coaching International Inc. from claims arising from your use of the Website.

19. Arbitration Agreement

Any dispute shall be resolved by binding arbitration conducted in San Diego, California, unless otherwise required by law.
